Terms and Conditions Agreement

Please read this agreement carefully.  By Clicking “I Accept, ” you agree to be bound by the terms of this agreement, and you represent and warrant that you have all authority necessary to bind yourself to this agreement.  If you do not agree with these terms, Do Not Accept.

In the following paragraphs “You” refers to Customers of “Mamisma Chicago” or users of www.mamismachicago.com

 Confidentiality:

Mamisma’s confidential information shall include all materials, products, technology, computer programs, and other business information disclosed or submitted, orally, in writing, or by any other media, to “You” the user of Mamisma.  Information related to www.mamismachicago.com and/or Mamisma products or services is deemed proprietary information under the ownership of Mamisma Chicago.  It is understood and agreed upon that any confidential information disclosed or provided by Mamisma Chicago to “You”  the user will be kept confidential.  Said information is intended for your sole and exclusive use.  You are fully responsible for maintaining confidentiality of your account access information.

• Mamisma Chicago guarantees that all manners of entry will be kept in the strictest confidence
• No client information will ever be knowingly disclosed to third parties without prior consent.

 

General Terms:

You agree and represent that you are buying only for your own personal use and not for resale or export.  You acknowledge that you do not have any life-threatening  food related allergies.  Mamisma Chicago requests that you consult with a physician before starting any meal programs or purchasing any of our products, meals, or services.  Mamisma Chicago does not guarantee that any of our meal programs, products, or services provide any physical, mental or spiritual benefit.

 

Allergies:

Mamisma Chicago does not guarantee that specific foods or client food dislikes will be excluded from any meal plan, entrée, snack, or other product(s) provided by Mamisma Chicago.  Mamisma Chicago does not accept responsibility for any injury, allergic reaction, or fatality resulting from the inclusion and subsequent ingestion of any food ingredient.

 

Food Sensititivities/Gluten Free, Dairy Free, etc:

Although Mamisma Chicago makes every attempt to provide foods that are free of gluten, dairy, and other stated ingredients (ie, soy, nuts, egg, etc), all meals and food products provided by Mamisma are not guaranteed 100% free of said substances.  All of our meals and food products are prepared on our with equipment shared with dairy, gluten containing, and most every type of food products.  We make every effort to avoid any cross-contamination between food products and uphold the strictest sanitation procedures.  Mamisma Chicago’s use of the term “Free” on any of the nutritional key of menus and elsewhere is to be interpreted as “not blatantly containing said product(s) (i.e. dairy, gluten, soy, eggs, etc)

The Mamisma Programs are not intended for those with Celiac disease or true medical allergies to gluten or dairy products.

 

Payment and Fees:

All pricing for goods and services are based on the market and our costs to produce said goods and services.  All pricing is subject to change.  Notification of price changes will be posted prior to billing and/or delivery at said prices.  You agree to pay Mamisma Chicago goods and services fees as declared on www.mamismachicago.com or by an official Mamisma Chicago representative.  Fees are calculated based on pricing provided by any of the above sources; all applicable taxes will be added.  You are solely responsible for payment.  Mamisma Chicago will accept payment by credit card, check or money order.  Once a charge has been processed to your credit card account, you agree not to request your credit card company to reverse the charge or charge it back to Mamisma Chicago.

• Mamisma Chicago accepts payment by check, money order or credit card.
• Failure to make payment will result in the termination of membership and/or services and submission to collections.
• Mamisma Chicago is not liable for any lost, stolen products, goods or services.
• Mamisma Chicago is not liable for food items that spoil due to prolonged exposure to outdoor elements.
• All food items must me properly stored and refrigerated upon receipt and no later than 2 hours after delivery time.

 

Food Safety:

You agree:

• NOT to consume meals and food products after the stated expiration date on each menu and/or food container.
• When heating meals or other food products you will do so in an over or microwave; using an over/microwave safe dish or container.
• You will transfer the food from the container it is delivered in prior to heating (unless container is over/microwave safe).
• You will not eat any food without heating unless package states otherwise (i.e. salad).
• You will discard any uneaten portions once heated.
• You will discard all meals after assigned dates.
• You will follow the heating directions included with each entrée.
• You will cook all food products thoroughly according to USDA guidelines.

Entrée Changes & Substitutions:

Mamisma does not change any meal ingredients or side dishes such as vegetables, starches, sauces, dressings, etc. within the standard meal service.  We recommend you substitute side dishes on your own, but be aware that this will affect calorie content. Requests WILL be considered and additional fees will apply.

 

Delivery:

All Mamisma food items will be delivered in a food safe cooler with frozen ice packs.  Mamisma is not responsible for meal deliveries that spoil due to prolonged exposure to heat or other outdoor elements.  Deliveries may be delayed occasionally due to situations outside of Mamisma’s control.  Mamisma reserves the right to increase delivery fees.

 

• Mamisma requests that all food products be refrigerated upon receipt.
• Coolers should be kept until next delivery time.
• Mamisma guarantees that all modes of entry shall be kept strictly confidential.

 

Delivery Address  Changes:

• Mamisma requires a minimum of two business days before your scheduled delivery

 

Cancellations:

All delivery and/or meal cancellations must be made 72 hours in advance of scheduled delivery time and made during the business week (Monday-Friday only).

 

Coolers:

All coolers are to be considered the property of Mamisma.  Mamisma is not responsible for any lost, stolen, or missing coolers.  You accept responsibility and agree to place empty coolers outside for retrieval.  Unreturned and/or lost coolers are billed on Friday of each week when they are not retrieved.

 

Termination of Services:

Mamisma reserves the right to terminate any membership programs, delivery of products, or terms or conditions of membership without limitation.  All programs and services may change or be discontinued at any time without notice.

 

Third Party Sites:

Mamisma may provide links to third-party web sites on their respective sites.  Mamisma is not responsible for the content of linked third-party sites, sites framed within the Mamisma website, third party sites provided as search results, or third party advertisements, and does not make any representations regarding their content or accuracy.  Your use of third-party websites is at your own risk and subject to the terms and conditions for such sites.

 

Policy Additions & Alterations:

Mamisma retains the right to change the terms and conditions at any time.  By continuing to use the site or by continuing to accept our products and services following any changes you will be deemed to have accepted such changes.  It is your responsibility to check regularly to determine whether these terms and conditions have been changed.  If you do not agree to any such change you must immediately contact Mamisma to cancel your current orders and stop using the site.

 

By clicking "I Accept" you acknowledge that you have read and fully understand the information provided above regarding Mamisma’s general policies, payment policies, delivery policies, and so forth.  By signing, you hereby authorize Mamisma to charge your credit card for the goods and services that you have ordered.
